Eli Lilly Forced To Remove Restrictions

Eli Lilly is exempting Arkansas from its new 340B contract pharmacy restrictions due to Arkansas state law.

The decision, communicated in a November 13 letter, means the stricter rules won't apply to Arkansas entities, citing the state's Act 1103. It's unclear if similar exemptions will extend to Louisiana. Lilly's initial November 6 notice restricted 340B-priced product distribution but allowed exceptions. The recent letter ensures Arkansas follows Lilly's existing contract pharmacy policy, contingent on legal rulings on Act 1103's constitutionality, currently under challenge in the 8th U.S. Circuit Court of Appeals.
